DigitalYoke – Terms of Service

(Effective Date:1/4/2025)

These Terms of Service (“Terms”) govern your access to and use of the Digitalyoke.com website, cloud ERP software, and related services (“Service”) provided by Sants Corporate Business (“Digitalyoke,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, Refund & Cancellation Policy, Copyright Policy, and Account Registration Policy.

If you do not agree with these Terms, do not use the Service.

1. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction).

• You must be legally capable of entering into a binding contract.

• If registering on behalf of an organization, you must have the authority to bind that organization to these Terms.

2. Account Registration

• You must provide accurate and complete registration information, as outlined in our Account Registration Policy.

• You are responsible for maintaining the confidentiality of your login credentials.

• Any unauthorized use of your account must be reported immediately.

• Digitalyoke is not responsible for losses caused by your failure to secure your account.

3. Free Trial

• New customers receive a 15-day free trial starting from the date of first access.

• No payment is required during the free trial period.

• At the end of the trial, you will be automatically moved to a monthly subscription unless you cancel before the trial ends.

4. Subscription & Billing

• Digitalyoke operates on a monthly subscription basis.

• Billing occurs on the last day of each month.

• A 30-day credit period applies from the invoice date.

• If payment is not received within 30 days, your account will be permanently deleted, and all associated data will be removed from our systems.

• You may choose to pay in advance for multiple months.

5. Refund & Cancellation Policy

• If you have paid for more than one month in advance and cancel your subscription, any unpaid dues will be deducted from the advance payment, and the balance will be refunded within 30 days after verification.

• No refunds are provided for the current month’s subscription after service has been accessed.

• Refund requests must comply with our Refund Policy.

6. User Responsibilities

When using the Service, you agree to:

• Use it solely for lawful business purposes.

• Ensure the accuracy of all data entered into the system.

• Comply with all applicable local, national, and international laws.

• Not share, sell, or transfer your account access without permission.

7. Intellectual Property

• All content, software, features, and materials of Digitalyoke are protected under copyright and other intellectual property laws.

• You may not copy, modify, reverse-engineer, or create derivative works without prior written consent.

• You retain ownership of your uploaded data but grant Digitalyoke a non-exclusive license to use it for service provision.

8. Prohibited Activities

You agree not to:

• Attempt to bypass our security measures.

• Use the Service to create competing products.

• Upload or share content that infringes intellectual property rights.

• Engage in fraudulent, abusive, or illegal activities.

9. Data Retention & Deletion

• If your account is terminated or deleted, all associated data (including databases, files, and server content) will be permanently deleted.

• We are not responsible for storing or retrieving data after account deletion.

10. Termination of Service

We may suspend or terminate your account if:

• You violate these Terms or other policies.

• You fail to pay your subscription fees within the 30-day credit period.

• You engage in activities that harm Digitalyoke or its users.

11. Limitation of Liability

• The Service is provided “as is” without warranties of any kind.

• We are not liable for any loss of business, revenue, or data resulting from your use or inability to use the Service.

12. Changes to the Terms

• We reserve the right to update these Terms at any time.

• Changes take effect immediately upon posting on Digitalyoke.com.

• Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts in Cochin, Kerala.
